Prandaj, parashtrojm\u00eb disa k\u00ebrkesa t\u00eb qarta:<\/p>\n<ul>\n<li>Ndryshimet aktuale t\u00eb Kodit penal t\u00eb kufizohen ekskluzivisht n\u00eb rikthimin e zgjidhjeve q\u00eb ishin n\u00eb fuqi para vitit 2023, pa futur koncepte t\u00eb reja.<\/li>\n<li>T\u00eb t\u00ebrhiqen ose t\u00eb rishikohen n\u00eb m\u00ebnyr\u00eb t\u00eb thelluar dispozitat p\u00ebr konfiskimin e zgjeruar, t\u00eb cilat mund\u00ebsojn\u00eb sekuestrimin e pasuris\u00eb pa procedur\u00eb penale dhe pa d\u00ebnim gjyq\u00ebsor.<\/li>\n<li>T\u00eb mos ngushtohet nocioni &#8220;p\u00ebrfitim&#8221; vet\u00ebm n\u00eb p\u00ebrfitim pasuror te veprat p\u00ebr shp\u00ebrdorim t\u00eb pozit\u00ebs zyrtare dhe pun\u00eb t\u00eb pand\u00ebrgjegjshme, me \u00e7&#8217;rast krijohet rrezik p\u00ebr mosnd\u00ebshkim t\u00eb formave serioze t\u00eb korrupsionit.<\/li>\n<li>T\u00eb ruhet ose t\u00eb futet nj\u00eb formulim q\u00eb mund\u00ebson sigurimin e nj\u00eb mbrojtje efektive penale ndaj keqp\u00ebrdorimeve t\u00eb r\u00ebnda, por atipike, t\u00eb pozit\u00ebs zyrtare.<\/li>\n<li>Para miratimit t\u00eb ndryshimeve, t\u00eb mbahet nj\u00eb debat publik dhe profesional, nd\u00ebrsa ndryshimet t\u00eb mos miratohen me procedur\u00eb t\u00eb shpejt\u00eb.<\/li>\n<\/ul>\n<p>K\u00ebto k\u00ebrkesa jan\u00eb ve\u00e7an\u00ebrisht t\u00eb r\u00ebnd\u00ebsishme duke pasur parasysh se p\u00ebr ndryshimet n\u00eb vitin 2023, reaguam n\u00eb koh\u00eb, duke paralajm\u00ebruar p\u00ebr pasojat q\u00eb fatkeq\u00ebsisht, sot konfirmohen n\u00eb praktik\u00eb.<\/p>\n<p>Pse jan\u00eb problematike k\u00ebto ndryshime?<\/p>\n<ol>\n<li>Konfiskimi i zgjatur (neni 98-a)<\/li>\n<\/ol>\n<p>Ndryshimet e propozuara p\u00ebr konfiskimin e zgjatur devijojn\u00eb ndjesh\u00ebm nga modeli q\u00eb zbatohej para vitit 2023. N\u00eb vend t\u00eb konfiskimit t\u00eb pasuris\u00eb s\u00eb fituar para kryerjes s\u00eb vepr\u00ebs penale, pas nj\u00eb procedure penale dhe d\u00ebnim gjyq\u00ebsor, tani \u00ebsht\u00eb e mundur konfiskimi pa p\u00ebrgjegj\u00ebsi penale t\u00eb p\u00ebrcaktuar. Ky \u00ebsht\u00eb nj\u00eb ndryshim thelb\u00ebsor q\u00eb ndryshon karakterin e mas\u00ebs.<\/p>\n<p>Nj\u00eb qasje e till\u00eb i afrohet t\u00eb ashtuquajturit konfiskim civil, pa u p\u00ebrcaktuar qart\u00eb se kush dhe p\u00ebr \u00e7far\u00eb mban p\u00ebrgjegj\u00ebsi, p\u00ebrkat\u00ebsisht cila \u00ebsht\u00eb vepra penale q\u00eb e b\u00ebn t\u00eb zbatueshme konfiskimin e zgjeruar. P\u00ebr m\u00eb tep\u00ebr, ky model \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me Ligjin ekzistues p\u00ebr procedur\u00ebn penale dhe krijon rreziqe p\u00ebr t\u00eb drejt\u00ebn e pron\u00ebs, prezumimin e pafaj\u00ebsis\u00eb dhe sigurin\u00eb juridike. Prandaj, me k\u00ebto ndryshime, edhe pse t\u00eb destinuara p\u00ebr sanimin e p\u00ebrkohsh\u00ebm t\u00eb korniz\u00ebs juridike deri n\u00eb miratimin e nj\u00eb Kodi t\u00eb ri penal, p\u00ebrs\u00ebri futet nj\u00eb koncept i ri pa rregulla t\u00eb qarta.<\/p>\n<ol start=\"2\">\n<li>Shp\u00ebrdorimi i detyr\u00ebs (neni 353) dhe efektet n\u00eb luft\u00ebn kund\u00ebr korrupsionit<\/li>\n<\/ol>\n<p>N\u00eb rastin e shp\u00ebrdorimit t\u00eb detyr\u00ebs, ndryshimet ngushtojn\u00eb ndjesh\u00ebm p\u00ebrgjegj\u00ebsin\u00eb penale. Termi \u201cp\u00ebrfitim\u201d reduktohet vet\u00ebm n\u00eb p\u00ebrfitim pron\u00ebsor, duke dal\u00eb k\u00ebshtu jasht\u00eb fush\u00ebveprimit t\u00eb formave t\u00eb keqp\u00ebrdorimit q\u00eb jo gjithmon\u00eb sjellin p\u00ebrfitim t\u00eb drejtp\u00ebrdrejt\u00eb financiar, si ndikim, favorizim apo kusht\u00ebzim.<\/p>\n<p>P\u00ebrve\u00e7 k\u00ebsaj, krahasuar me versionin para vitit 2023, d\u00ebnimet maksimale p\u00ebr format m\u00eb t\u00eb r\u00ebnda t\u00eb krimit zvog\u00eblohen, gj\u00eb q\u00eb \u00e7on drejtp\u00ebrdrejt n\u00eb periudha m\u00eb t\u00eb shkurtra t\u00eb parashkrimit. Kjo do t\u00eb thot\u00eb se ende ekziston m\u00eb pak hap\u00ebsir\u00eb p\u00ebr t\u00eb ndjekur penalisht n\u00eb m\u00ebnyr\u00eb efektive rastet komplekse t\u00eb korrupsionit, ve\u00e7an\u00ebrisht ato q\u00eb zbulohen gjat\u00eb nj\u00eb periudhe m\u00eb t\u00eb gjat\u00eb kohore.<\/p>\n<p>Nj\u00ebkoh\u00ebsisht, futet nj\u00eb inkriminim i ri n\u00eb vend q\u00eb t\u00eb kthehet dispozita e vjet\u00ebr e paragrafit 5. Me ndryshimet e propozuara rikthehet vet\u00ebm inkriminimi p\u00ebr shp\u00ebrdorimin e pozit\u00ebs dhe kompetenc\u00ebs zyrtare n\u00eb procedurat e prokurimeve publike, por jo p\u00ebr format e tjera t\u00eb keqp\u00ebrdorimit t\u00eb fondeve buxhetore, t\u00eb fondeve publike ose t\u00eb mjeteve t\u00eb tjera t\u00eb shtetit. P\u00ebr m\u00eb tep\u00ebr, disa nga veprimet q\u00eb p\u00ebrfshihen kan\u00eb karakter t\u00eb shkeljeve administrative, gj\u00eb q\u00eb mund t\u00eb \u00e7oj\u00eb n\u00eb kriminalizim t\u00eb tepruar pa forcim real t\u00eb luft\u00ebs kund\u00ebr korrupsionit.<\/p>\n<p>Ve\u00e7an\u00ebrisht shqet\u00ebsuese \u00ebsht\u00eb se me k\u00ebto ndryshime nuk sigurohet mbrojtje e duhur e mjeteve nga fondet publike dhe fondet e Bashkimit Evropian, gj\u00eb q\u00eb bie ndesh me angazhimet e shpallura p\u00ebr forcimin e sundimit t\u00eb ligjit.<\/p>\n<ol start=\"3\">\n<li>Pun\u00eb e pand\u00ebrgjegjshme n\u00eb sh\u00ebrbim (neni 353-v)<\/li>\n<\/ol>\n<p>Tek vepra penale pun\u00eb e pand\u00ebrgjegjshme n\u00eb sh\u00ebrbim, propozohet heqja e formulimit q\u00eb deri tani sh\u00ebrbente si &#8220;rrjet mbrojt\u00ebs&#8221; p\u00ebr nd\u00ebshkimin e rasteve t\u00eb r\u00ebnda, por jo tipike, t\u00eb pand\u00ebrgjegj\u00ebsis\u00eb zyrtare. Edhe pse ka nevoj\u00eb q\u00eb dispozitat e tilla t\u00eb formulohet me kujdes p\u00ebr t\u00eb shmangur zbatimin arbitrar, heqja e tyre e plot\u00eb krijon rrezik q\u00eb shkeljet serioze t\u00eb mbeten pa nd\u00ebshkim.<\/p>\n<ol start=\"4\">\n<li>Procedura p\u00ebr propozimin e ndryshimeve<\/li>\n<\/ol>\n<p>Edhe pse nevoja p\u00ebr nd\u00ebrhyrje ishte e qart\u00eb, shqet\u00ebson \u00ebsht\u00eb m\u00ebnyra se si propozohen k\u00ebto ndryshime. Ato u dor\u00ebzuan pa paralajm\u00ebrime t\u00eb m\u00ebparshme dhe pa konsultime publike, edhe pse ishte paralajm\u00ebruar krijimi i nj\u00eb grupi punues n\u00eb Ministrin\u00eb e Drejt\u00ebsis\u00eb. Kjo krijon p\u00ebrshtypjen e proceseve paralele dhe t\u00eb pakoordinuara dhe zvog\u00eblon besimin n\u00eb cil\u00ebsin\u00eb e zgjidhjeve t\u00eb propozuara.<\/p>\n<p>Duke pasur parasysh p\u00ebrvoj\u00ebn e m\u00ebparshme me ndryshime t\u00eb shpejta dhe t\u00eb pamenduara t\u00eb Kodit Penal, konsiderojm\u00eb se \u00ebsht\u00eb e nevojshme nj\u00eb debat publik dhe profesional, p\u00ebr t\u00eb mos u p\u00ebrs\u00ebritur praktika e &#8220;korrigjimit&#8221; formal t\u00eb ligjit pa zgjidhje reale t\u00eb problemeve. P\u00ebr k\u00ebt\u00eb arsye, n\u00eb nj\u00eb periudh\u00eb kur po p\u00ebrgatitet nj\u00eb Kod i ri penal n\u00eb t\u00ebr\u00ebsi, qasja m\u00eb p\u00ebrgjegj\u00ebse \u00ebsht\u00eb rikthimi i zgjidhjeve t\u00eb provuara para vitit 2023, pa futur modele t\u00eb reja me pasoja t\u00eb gjera afatgjata.
